The BAPCPA of 2005 expanded the small business provisions and modified section 1115 to include income earned by the debtor as part of the bankruptcy estate. Most insolvency professionals know that they are required to disclose all connections in order to have their retention approved by the Bankruptcy Court, but what constitutes a connection and how detailed must the disclosure be? Recent cases have made clear that non-Bankruptcy restrictions on conflicts apply in Bankruptcy. Failure to comply with these requirements may result in denial of fees or even disgorgement of fees previously paid. This panel will guide participants through these sometimes arcane rules and steps to ensure their fees are approved. |
