What actions are outside the scope of authority resulting in a loss of the Barton doctrine protection?

Description: The panelists will provide an overview of recent financial reporting standards, SEC developments and an update on the IRFS, International Accounting Standards and US GAAP Accounting Standards convergence efforts. The session will focus on how these may impact reporting requirements for distressed companies or companies planning to emerge from bankruptcy that may be subject to some of these reporting requirements or early adoption, e.g. public debt holdings.

The panel will also discuss other FASB projects and highlight recent subjects related to valuation FAS 157 (Fair Value Measures) and FAS 141R / FAS 160 (Business Combinations and Non-Controlling Interest). Furthermore, the panel will also highlight some of the more recent pronouncements, such as FAS 161 (Disclosures about Derivatives Instruments and Hedging) and FAS 162 (Hierarchy of Generally Accepted Accounting Principles) and how they may impact our practitioners.

It will focus on the practical difficulties involved in finding buyers and in financing transactions in today’s difficult market, and on the advantages and disadvantages of particular sale methodologies. You will hear from a preeminent insolvency lawyer, an expert turnaround and asset sale consultant, and a specialist in the marketing and sale of distressed companies.

Description: Panelists will address the financial and economic outlook for President Obama and comment on the state of the bailout, banking and regulatory environments. An economic overview will be followed by an evaluation of the stated intentions, management and success of the government’s bailout efforts originating in Fall 2008. The panel will then review President Obama’s policy options and comment on the outlook for the new administration and the future prospects for the U.S. economy.
