This issue covers a variety of
topics that should be of value to our members. As you have noticed,
we are covering international insolvency issues on a fairly regular
basis. This trend reflects the evolution of insolvency laws around
the world and the expertise U.S. practitioners bring to the field.
In Miles Stover’s article “Oh My,
the New Client Owns a Plant in Mexico! What do we do Now?,”
we get an interesting overview of labor law and cultural issues
related to Mexico. I think an important lesson to take away from
his article is you must understand your areas of expertise and
leverage the proper resources, particularly when dealing with
international transactions.
“Turnarounds & Workouts: What the Forecast?”
provides an interesting perspective on factors and trends affecting
the turn-around industry. Daniel Dooley predicts an increase in
activity in 2006 that many will appreciate. Forrest Lewis covers
section 505(b) in “Requesting Prompt Tax Determination Under
505(b),” which highlights the benefits and process of requesting
a tax determination letter. And, of course, Alan Barton always
manages to explore cases with interesting tax issues and consequences,
like this month’s explanation of how to use NOLs created
by an estate to benefit a successor, even for the years in which
the bankruptcy was pending.
We are continuing to seek interesting topics
and new authors. If you are interested in writing for the AIRA
newsletter, please check out our website for publication guidelines
and submission dates.

Peter Stenger
is a Director in the Restructuring and Performance Improvement
group at Stout Risius Ross, Inc., and is responsible for strategic,
operational and financial consulting solutions for turnaround
and underperforming clients. He has spoken on bankruptcy and strategic
planning issues for the Turnaround Management Association, for
the Association of Insolvency and Restructuring Advisors at the
National Conference of Bankruptcy Judges, and for other international
organization in North America and Europe. He earned his BB/A in
