Dear AIRA Members:
AIRA continues to accelerate
its efforts to provide high quality education materials and seminars
as we finish up 2005 and begin 2006. A visit to our website is
a testament to the significant advances we’ve made.
The Bankruptcy Abuse Consumer
Protection Act of 2005 has underscored the importance of providing
easily accessible reference materials for our members.
AIRA and Grant Newton partnered
with the AICPA for the publication of the 2005 Bankruptcy Revision
– Implications For Business and Financial Advisors. This
book concisely focuses on the financial and tax aspects of the
new Bankruptcy Act relevant to both businesses and consumers and
was edited by Grant Newton. It is a well-timed publication detailing
the drastic changes imposed by the new law on bankruptcy practitioners.
Other highlights on the web
site include the New 2005 Revised Version Overview Of Bankruptcy
Laws by Professor Jack F. Williams, Scholar in Residence at the
AIRA, a Summary of Tax Provisions in New Bankruptcy Law by Grant
Newton and a paper on the New Act by Grant Stein, Mark Dudell
and David Wender of Alston & Bird, LLP.
AIRA’s teleconferences
on Tax Provisions and Impact of the new Bankruptcy Law, and Business
Provisions and Impact of the new Bankruptcy Law have been well
received. The teleconference recording and presentation material
are available at www.airacira.org for any interested member.
The very popular Advanced Plan
of Reorganization conference will be held in New York on November
17. The seminar on Legal and Financial Perspectives on Business
Valuations and Restructuring in Las Vegas is offered in 2006 in
conjunction with the University of Texas School of Law.
Mark your calendars for the AIRA
22nd Annual Bankruptcy and Restructuring Conference from June
7 to 10, 2006 at the Grand Hyatt Seattle in Seattle, Washington.
Planning is already underway and Justin McCord invites suggestions
for topics. We welcome Justin to the AIRA as the new Conference
Director.
On November 4, 2005, the AIRA
again presents a discussion on “Who Is Running This Case
And For Whose Benefit?” at the NCBJ breakfast. We can certainly
look forward to an exciting discussion on this subjective topic.
We look forward to meeting several of our members at the NCBJ
Breakfast.

R. Kapila, CPA, CIRA, CFE, is the founding principal
of Kapila & Company which has concentrated its efforts for
many years in the areas of consulting and representing bankruptcy
debtors, creditor bodies and trustees. His practice is concentrated
in the areas of creditors’ rights, bankruptcy and financial
transactions litigation. He also regularly advises clients about
the insolvency implications involved in business transactions.
Mr. Kapila has served as Bankruptcy Trustee, Examiner and state
Court Receiver in numerous matters in the Southern District
of Florida. He has advised and represented debtors and creditors’
committees in formulating, analyzing and negotiating plans of
reorganization.
